Terms of Service

These Terms of Service ("Terms") govern your use of the website and app operated by UnKlaimed, LLC ("UnKlaimed," "we," "us"). By creating an account, searching, or filing a claim, you agree to these Terms. If you do not agree, do not use the service.

1. What we do

UnKlaimed is a private unclaimed-property finder/recovery service. We search official state records, help you verify your identity, prepare and file the required claim forms, and track your claim until the state issues payment. We are not a law firm, a government agency, or affiliated with any state. You can always search for and claim your property for free, directly with your state.

2. Eligibility and authorization

You must be at least 18 and legally entitled to the property you claim (as the owner, an heir, or an authorized representative). By using the service you authorize UnKlaimed to act as your finder/agent to prepare and submit your claim, and you agree that the information you provide is true and accurate.

For approved claims, the recovered property is paid by the state to you as the rightful owner or heir — it is not paid to UnKlaimed and then passed on. In some states, including California, the state pays our recovery fee to us separately and at the same time, as a second payment made directly by the state under our registered investigator agreement. In those states you receive your share from the state and are never billed by us. Section 3 explains how the fee works in each case.

3. Fees

Searching and filing are free. We charge a recovery fee only if we successfully recover your property.
Our fee is 10% of the amount recovered, and never more than the maximum your state's law allows (some states are lower).
You will see your exact fee before you agree to anything, in a written agreement you sign in the app.
If nothing is recovered, you owe nothing. There is never a charge up front, in any state.

How the fee is collected depends on the state that holds your property. There are two models, and the app tells you which one applies to your claim before you sign anything:

State-paid states (currently California). We are a registered investigator with that state, and the state pays our fee to us directly as a separate payment at the same time it pays you your share. You are never charged by us and we do not ask you for a payment method. We deduct nothing from your payment; the state calculates your share from the fee you agreed to when you signed, and pays it to you.
Claimant-paid states (all our other states). The state pays you the full recovered amount, and we then collect our fee from you. You are charged only after your money has reached you. You may confirm receipt in the app, or we will collect the fee shortly after your payment is expected to have arrived. By providing a payment method you authorize UnKlaimed to charge the recovery fee to it once those conditions are met.

4. Your right to claim for free

You are never required to use UnKlaimed. Unclaimed property can be claimed for free directly from the state that holds it. Some states also require, or recommend, that you check with the state office before signing any agreement to pay for recovery services. We encourage you to do so.

5. State waiting periods

Several states bar a paid recovery service from entering into an agreement with you until the property has been in the state's custody for a set period. In California that period is 24 months, and an agreement made within it is void by statute (Code of Civil Procedure §1582).

Where a waiting period applies and the property has not yet cleared it, we will tell you, we will not ask you to sign anything, and no agreement between us takes effect. You remain free to claim the property directly from the state at any time, including immediately. If you ask us to, we will notify you when the waiting period ends.

6. Identity verification and notarization

To prevent fraud and meet state requirements, we verify your identity and, for certain claims (for example, claims of $1,000 or more, securities, or safe-deposit-box contents in some states), arrange remote online notarization through a licensed provider. Completing these steps is required to file those claims.

7. No guarantee

We cannot guarantee that any claim will be approved or that the state will pay any particular amount or within any particular time. State review timelines vary and can take from a few weeks to several months. We are not responsible for state decisions or delays.

8. Cancellation

You may cancel a claim that has not yet been filed with the state at any time, from your dashboard or by contacting us. Once a claim has been filed with the state, contact us and we will help you cancel or withdraw where possible.

9. Disclaimers and limitation of liability

The service is provided "as is." To the fullest extent permitted by law, UnKlaimed disclaims all warranties and shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim relating to the service shall not exceed the fees you paid us for the claim at issue.

10. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules, except where the law of the state where your property is held applies to the claim itself.

11. Changes

We may update these Terms from time to time. Material changes will be posted here with a new "last updated" date; continued use after changes means you accept them.
